The new Safety and Health Topics page, OSHA Assistance for the Cleaning Industry, provides information on potential hazards, such as slips, trips and falls, OSHA standards, and links to free resources from OSHA and other organizations. The web page was developed by OSHA with input from ISSA, a cleaning industry trade association, as part of the OSHA and ISSA Alliance. OSHA is the leading resource on safety and health issues for employers and employees in all industries, said Assistant Secretary of Labor for OSHA Edwin G. OSHA Publishes Notice of Proposed Rulemaking for New Respirator Fit-Testing Protocol
The Occupational Safety and Health Administration (OSHA) today published a Notice of Proposed Rulemaking (NPRM) in the Federal Register (www.osha.gov) for a new fit-testing protocol -- the Abbreviated Bitrex Qualitative Fit-Testing (ABQLFT) protocol -- under Appendix A of OSHA's Respiratory Protection standard. The agency is accepting public comments until Feb. 25, 2008. This proposed rule will add a new fit-test method that has a shorter exercise duration than the current methods, said Assistant Secretary of Labor for OSHA Edwin G. Foulke, Jr. This method will give employers additional flexibility in selecting procedures for conducting fit-testing.

OSHA records another successful enforcement year in FY 2007
The Occupational Safety and Health Administration (OSHA) recently released its annual enforcement statistics, confirming that the agency's enforcement programs are producing positive results for the benefit of American workers. In FY 2007, OSHA conducted 39,324 total inspections, a 4.3 percent increase over its stated goal of 37,700. Total violations of OSHA's standards and regulations were 88,846, a 6 percent increase from Fiscal Year (FY) 2006. The agency cited 67,176 serious violations, a 9 percent increase from the previous year and a more than 12 percent increase over the past four years. The number of cited repeat violations also rose from 2,551 in FY 2006 to 2,714 in FY 2007.

But, as I've said the battle isn't over. Edwards Lifesciences Corporation announced that it has received conditional approval from the U.S. Food and Drug Administration (FDA) for a revised design to the U.S. pivotal clinical trial of the Edwards SAPIEN transcatheter aortic heart valve technology. The FDA approved the addition of the Ascendra transapical delivery system to the trial, and also granted permission to Edwards to increase its trial sample size from 600 patients to 1,040 patients. The PARTNER (Placement of AoRTic traNscathetER valves) trial, initiated in the second quarter of 2007, is evaluating the Edwards SAPIEN valve in patients who are considered high risk or inoperable for conventional open-heart valve surgery.

OSHA Announces New Alliance with Process Safety Group
Process safety and the management of chemical reactivity hazards are the goals of a new Alliance between the U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) and the Process Safety Alliance. The OSHA and Process Safety Alliance will work to provide its participating members, small businesses and the public with process safety information, guidance, and access to training resources. Those working in the chemical and petroleum industries face significant hazards daily as they mix, manufacture, and package a variety of dangerous compounds, said Assistant Secretary of Labor for OSHA Edwin G. Real ID Final Rule Enables States to Begin Work on Technologies for Compliance
he final rule for REAL ID compliance provides the necessary guidance for states to begin building systems and linking networks to fulfill the mandates of the 2005 legislation, according to a newly released report by INPUT, the authority on government business. While states have until May 11, 2008 to declare their intention to comply with REAL ID, INPUT does not expect widespread resistance to derail the new approach. Compared to the proposed rule of last March, DHS has made a credible effort to reduce or eliminate Constitutional as well as procedural and technical barriers to REAL ID compliance in many areas of the final rule, said Chris Dixon, manager, state and local industry analysis for INPUT.

OSHA has released Preventing Skin Problems from Working with Portland Cement, a new guidance document created to educate employers and employees about effective ways to prevent skin-related injuries in the cement and cement-related industries. Wet portland cement can damage the skin because it is caustic, abrasive, and absorbs moisture. It also contains trace amounts of hexavalent chromium, a toxin harmful to the skin. MiFiD: 50% say regulators slipping on guidance
With less than 100 days before the 1 November deadline many financial services firms are unhappy with the support they are receiving from their national regulators as they prepare for the Markets in Financial Instruments Directive, found a survey by SunGard and TradeTech. Half the 300 respondents stated that their national regulators were either “bad” (32%) or “very bad” (19%) in helping them to get ready for the directive.
In the UK, respondents were divided on whether the Financial Services Authority’s minimal guidance, principles-based approach to MiFID was a good one – only 54% believed that this is “the best approach to prevent regulatory overload”, with the remaining respondents stating that this approach “makes it difficult to understand exactly what requirements the FSA desires, adding to the compliance task”.
The survey showed an overall increase in MiFID readiness – 53% of respondents now believe their preparations for the directive are “ahead” or “right-on-track”, compared with just 34% in September 2006. However, opinions are still divided on whether MiFID will have a positive impact. The majority (54%) of institutions surveyed state that they see MiFID as just “another piece of compliance”. In addition, only 42% of respondents believe that MiFID will be good for Europe’s economy in the next 5 – 10 years, with over a third still undecided.

FDA Approves Avastin in Combination with Paclitaxel Chemotherapy for Cancer Treatment
Roche announced that Genentech has received U.S. Food and Drug Administration (FDA) accelerated approval for Avastin (bevacizumab), in combination with paclitaxel chemotherapy, for the first-line treatment of patients with locally recurrent or metastatic breast cancer. The approval is based on a phase III study (E2100) which showed that for patients with metastatic breast cancer the addition of Avastin to paclitaxel compared to paclitaxel alone doubled the chance of being alive without the disease advancing (progression-free survival). In Europe Avastin received full approval for the treatment of metastatic breast cancer in March 2007.

OSHA Issues Notice of Proposed Rulemaking for New Respirator Fit-Testing Protocol
The Occupational Safety and Health Administration (OSHA) published a Notice of Proposed Rulemaking (NPRM) in the Federal Register for a new fit-testing protocol -- the Abbreviated Bitrex Qualitative Fit-Testing (ABQLFT) protocol -- under Appendix A of OSHA's Respiratory Protection standard. The agency is accepting public comments until Feb. 25, 2008. This proposed rule will add a new fit-test method that has a shorter exercise duration than the current methods, said Assistant Secretary of Labor for OSHA Edwin G. Foulke, Jr. This method will give employers additional flexibility in selecting procedures for conducting fit-testing.

The U.S. Food and Drug Administration (FDA) is warning consumers about a potential Clostridium botulinum (C. botulinum) contamination of canned cut green beans manufactured by New Era Canning Company, New Era, Mich., and labeled as GFS Fancy Blue Lake Cut Green Beans. C. botulinum is the bacterium that causes botulism. The bacterium produces a toxin that can result in a life-threatening illness or death. To date, no illnesses have been reported in connection with this incident. The canned cut green beans were distributed to retailers, restaurants and foodservice institutions by Gordon Food Service, Grand Rapids, Mich., with lot code 19H7FL and UPC code 93901 11873, in large institutional-sized, 6 pound 5 ounce (#10) cans. The green beans were distributed to food service customers in Alabama, Arkansas, Georgia, Illinois, Indiana, Kentucky, Mississippi, Missouri, North Carolina, Tennessee, and Virginia and sold through GFS Marketplace stores in Indiana, Kentucky, and Tennessee. FDA Develops New Tools to Further Improve the Security of Food and Cosmetics
As part of the FDAs comprehensive Food Protection Plan initiative, the agency today released self-assessment tools for industry to minimize the risk of intentional contamination of food and cosmetics. The tools are companion pieces designed to make previously issued industry guidance documents more user-friendly and practical. Food protection is one of FDAs top priorities and that means guarding against both intentional and unintentional contamination of foods. The tools FDA is providing will help members of the food and cosmetic industry identify opportunities to better guard against intentional contamination of their products, said CFSAN Acting Center Director David Acheson.

FDA Issues Second Safety Warning on Fentanyl Skin Patch
The Food and Drug Administration today issued its second safety warning about the fentanyl transdermal system, an adhesive patch that delivers a potent pain medicine through the skin. In July 2005, the agency issued a similar warning to the public and to health care providers, saying that the directions on the product label and on the patient package insert should be followed exactly in order to avoid overdose. FDA has continued to receive reports of deaths and life-threatening side effects after doctors have inappropriately prescribed the patch or patients have incorrectly used it. In addition, the agency is asking manufacturers of all fentanyl patches to update their product information and to develop a medication guide for patients.

The U.S. Food and Drug Administration approved Kuvan (sapropterin dihydrochloride), the first drug of its kind approved to slow the effects of a rare genetic disorder that causes mental retardation, smaller brain size, delayed speech and other neurological problems. Tetrahydrobiopterin (BH4)-responsive phenylketonuria or PKU disease occurs in one out of every 12,000 to 15,000 live births in the United States. PKU is a genetic disorder in which the enzyme phenylalanine hydroxylase (PAH), which helps our bodies break down phenylalanine (Phe), an amino acid found in foods, does not function properly. The result is high levels of phenylalanine in the blood. High levels of Phe are toxic to the brain and can lead to mental retardation, behavioral abnormalities, seizures, an inability to focus and organize information, and other neurologic complications.

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) today proposed $845,100 in penalties against RPI Coating Inc. of Santa Fe Springs, Calif.,and $189,900 in proposed penalties against the Public Service Co. of Colorado, doing business as Xcel Energy, for alleged serious and willful violations of federal workplace safety and health standards following a tunnel fire last year that killed five employees. This catastrophe could have been avoided if the companies had followed their critical safety procedures, said Assistant Secretary of Labor for Occupational Safety and Health Edwin G. Foulke Jr. There should never be such a disregard for the safety of employees. Today's citations should serve as a reminder to all employers about the critical need to always provide a safe and healthful workplace for their employees.

The U.S. Food and Drug Administration is advising consumers not to purchase or use Blue Steel or Hero products marketed as dietary supplements throughout the United States because they are considered unapproved drugs and have not been proven to be safe or effective. These products contain undeclared ingredients, which may dangerously affect a persons blood pressure level. These products are promoted and sold over the Internet for the treatment of erectile dysfunction (ED) and for sexual enhancement. Theyre touted as all natural and labeled as dietary supplements. However, Blue Steel and Hero products do not qualify as dietary supplements because they contain undeclared and unapproved substances that are similar in chemical structure to sildenafil, the active ingredient in Viagra, an FDA-approved prescription drug for ED.

UK Information Commissionr takes enforcement action against Marks & Spencer
M&S ordered to encrypt all hard drives by April 2008
The Information Commissioner's Office (ICO) has found Marks & Spencer (M&S) in breach of the Data Protection Act. This follows the theft of an unencrypted laptop which contained the personal information of 26,000 M&S employees.
An ICO investigation revealed that the laptop, which contained details of the pension arrangements of M&S employees, was stolen from the home of an M&S contractor. In light of the nature of the information contained on the laptop, it is the ICO's view that M&S should have had appropriate encryption measures in place to keep the data secure.
Mick Gorrill, Assistant Commissioner at the ICO, said: "It is essential that before a company allows personal information to leave its premises on a laptop there are adequate security procedures in place to protect personal information, for example, password protection and encryption. The ICO has issued clear guidance to help employers understand their obligations under the Data Protection Act.

FDA Warns of Salmonella Risk with Cantaloupes from Agropecuaria Montelibano
The U.S. Food and Drug Administration has issued an import alert regarding entry of cantaloupe from Agropecuaria Montelibano, a Honduran grower and packer, because, based on current information, fruit from this company appears to be associated with a Salmonella Litchfield outbreak in the United States and Canada. The import alert advises FDA field offices that all cantaloupes shipped to the United States by this company are to be detained. In addition, the FDA has contacted importers about this action and is advising U.S. grocers, food service operators, and produce processors to remove from their stock any cantaloupes from this company. The FDA also advises consumers who have recently bought cantaloupes to check with the place of purchase to determine if the fruit came from this specific grower and packer. If so, consumers should throw away the cantaloupes.

FDA Approves New Medical Adhesive to Treat Burn Patients
The U.S. Food and Drug Administration today approved a new medical adhesive (a fibrin sealant) called Artiss for use in attaching skin grafts onto burn patients. Fibrin sealants are tissue adhesives that contain the proteins fibrinogen and thrombin, which are essential in the clotting of blood. Artiss (Fibrin Sealant, VH S/D 4) differs from other fibrin sealants in that it contains a lower concentration of thrombin. This lower concentration allows surgeons more time to position skin grafts over burns before the graft begins to adhere to the skin. Artiss also contains aprotinin, a synthetic protein that delays the break down of blood clots. The approval of Artiss can help surgeons using a fibrin sealant to fine tune graft placement on burn sites, said Jesse L. Goodman M.D., M.P.H., director of FDA's Center for Biologics Evaluation and Research. The approval also provides an additional choice for health care professionals in providing burn treatment.

Bereaved man sickened by marketing 'breach'
A consultant in data privacy has slammed a crematorium for its "tasteless" posting of marketing material, claiming that it broke the law.
Tim Trent, 55, cremated his mum Connie at North East Surrey Crematorium last November and thought that would be the end of the matter.
But three days later, he was stunned to find a glossy brochure on his doormat, advertising memorials, plaques, flowers and other services offered by the crematorium.
Mr Trent said: "It hit me in the face like a sledgehammer. We had a really good send-off for my mother, and thought that chapter of our life was closed. I didn't expect this at all, so it was gloriously distasteful."
